Terms of Use

1. General Provisions

Stalex is an independent app for iPhone and Apple Watch developed by Oleksandr Andriushko (sole proprietor), Ukraine. By using the app, you agree to these terms. The Apple Standard End User License Agreement (Apple Standard EULA) also applies.

2. NOT an Official Alert System

Stalex is not a government alert system.

Alert data is provided by the Trembita Pro service, and outage schedules by YASNO and the websites of DTEK and regional power companies (through the open projects outage-data-ua, OE_OUTAGE_DATA, and gpv-voe-vinnytsia); all of this is for information purposes only, with no guarantee of accuracy or timeliness; delays and connection failures may occur.

“STATUS UNKNOWN” does not mean there is no threat. ALWAYS respond to sirens, official apps, and announcements from the authorities.

3. Free Alert Signal

The alert map and alert signal for your sector are free for everyone and will never be paid. They don’t require an account or any purchases.

4. Stalex Flamingo

Paid features are optional Stalex Flamingo 🦩 packs, the in-app currency, and the Stalex Plus subscription (Section 4a). Flamingo is a one-time purchase via Apple In-App Purchase (no auto-renewal), charged to your Apple ID.

Flamingo has no cash value, cannot be exchanged for money, withdrawn or transferred to other people (except as gifts), and does not expire.

With Flamingo you can place ads in On Air, on the Transport card and in Sky, boost your channel to the top of the On Air Feed (marked “promoted”; after that its position depends on how lively the channel is — this is not pinning; Flamingo for a boost that has already taken place is not refunded) and buy gifts.

Prices of services in Flamingo may change; the current price is always shown before payment. Flamingo for an ad is reserved on submission and returned if the moderator rejects it or you withdraw it. Gifts may be given, but not sold, resold or exchanged; a gift that has been given is not returned.

Refunds are available only through Apple; after a refund, the corresponding Flamingo is deducted from your balance. An On Air channel costs Flamingo every month (the current price is shown before creation and payment); a period is free if the channel received gifts worth the set amount during the previous one.

If unpaid, the channel is suspended: the owner and admins cannot post or manage it until they pay; subscribers see everything as before. Channel gifts are not refundable.

4a. Stalex Plus

Stalex Plus is an optional monthly auto-renewing subscription purchased through Apple In-App Purchase.

It provides: transcription of voice messages and video notes into text, and translation (on iPhone); message edit history in Chats; viewing messages that the other person deleted “for everyone” (from the time you subscribe, only on your iPhone); scheduled messages and posts; “read without read receipts” (mutual); the ability to create channels and view channel statistics; a monthly Flamingo bonus and a discount on channel boosts; daily transit tracking; higher limits (power schedule places, tracking, and folders); a Plus badge, name color, animated avatar ring, live backgrounds, and animated emoji.

The amount of the bonus, the discount, and the limits may change; the current values are shown on the Stalex Plus page. Safety features (alerts, the map, SOS, statuses, and shelters) are not restricted by the subscription. Payment is charged to your Apple ID account at confirmation of purchase.

The subscription automatically renews at the same price unless it is canceled at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID settings.

After the subscription ends, channels you created remain (provided the monthly Flamingo payment is made), and saved copies of deleted messages and edits are hidden. Refunds are available only through Apple.

5. Account and Age

An account is required only for Chats and On Air; you can sign in only with Apple. Social features are for people aged 18 and over. Don’t impersonate others: only the developer has the founder badge, and names and @usernames containing the words owner, admin, administrator, власник, засновник, or модератор aren’t allowed.

A phone number is optional (verified through the Telegram bot @stalex_ua_bot). To delete your account, go to Profile → Account → “Delete account.” If you violate these terms, your access to Chats and On Air may be restricted or terminated.

6. User Content

Chats and On Air have ZERO TOLERANCE for offensive, violent, sexual or otherwise unlawful content, harassment, fake threat reports and spam. You can report a message, person, group or channel and block the author. We review reports, remove violating content and block violators within 24 hours. You are responsible for the content you send.

7. On Air

Regional chats are public; only text, stickers, voice messages and video messages can be sent there. In channels, the owner and the admins they appoint publish and are responsible for their channel. On Air is NOT end-to-end encrypted and is stored on the server (regional chats for 14 days, channels for 1 year) — don’t post personal data there.

The moderator may delete posts, restrict a user from posting (for 7 days or permanently) and block channels.

8. Ads

Every ad is reviewed by a moderator. Advertising alcohol and tobacco, gambling, weapons, 18+ content, fraud, and political campaigning is prohibited.

Formats are 320×50 banners: the region chat banner (at the top of the selected region’s chat for the entire paid period, with no posts in the feed) and the 320×50 gold banner, which follows the IAB “Mobile Banner” standard: a 640×100 or 960×150 px image (32:5), PNG, JPG, or GIF, up to 1.5 MB, shown to all users (in On Air below “Channels / Regions,” on the “Transport” card, and on the district card in “Sky,” including during an alert).

Duration ranges from 30 minutes to 24 hours; the price in Flamingo depends on the format and duration. Several ads may be shown at the same time; they rotate every 5 seconds. There may be any number of gold banners in the rotation (no limit), and the rotation order is different for each person and on each screen.

Your ad remains in this rotation for the entire paid period. The region chat banner has a limit on simultaneous ads, which is shown before you submit. Statistics (reach and clicks) are approximate and anonymous. You can edit an ad until review begins and withdraw it until it is approved.

9. SOS and Safety Statuses

SOS doesn’t replace calling 112. If you’re in danger, call 112. Delivery of SOS and statuses depends on the internet, Apple services, and recipients’ devices, and isn’t guaranteed. Don’t send false SOS alerts.

10. Encryption and history

Chat messages are end-to-end encrypted and stored only on participants’ devices. If you reinstall the app or replace your iPhone, the history can’t be restored — not by you, and not by the developer. On Air isn’t end-to-end encrypted.

10a. Calls

Calls are available between people who have a personal chat in Stalex, and only if the other person allows them. Calls do not replace phone service and are not intended for emergency calls — in danger, call 101, 102, 103 or 112.

We don’t guarantee connection or quality: when the service is overloaded, new calls are queued (“The secret line is busy”) — calls where at least one person has Stalex Plus go first, and ongoing calls without Plus are not dropped but may switch to a lighter video mode.

Using calls for harassment, spam or threats is prohibited — after a report we may restrict the account.

10b. Meetings

A meeting and a call each last at most 3 hours. Anyone with a Stalex profile can create a meeting; without Stalex Plus — up to 3 participants, with Plus — up to 10. The organizer decides who receives the invitation or link: anyone with the link can join while seats remain, and, if approval is on, after a participant lets them in.

Recording or broadcasting a meeting without participants' consent, sharing unlawful content, harassment and threats are prohibited. When the server is overloaded, new meetings may be available only with Stalex Plus.

10c. Stalex on your computer

Connect only your own computers to your account, and only when you have just opened Stalex on them yourself; never share your computer sign-in password. You are responsible for the security of the devices where you are signed in; you can end a session at any time in “Profile → Active sessions”. Up to 5 browsers can be connected.

Purchases are not available in the browser (Stalex Plus and Flamingo are bought only in the app via the App Store).

11. Prohibited Use

Prohibited: spreading false information about threats or sending false SOS alerts; impersonating official services, the developer, moderators, or other people; spam and harassment; attempting to access other people’s accounts or the server; reverse engineering; circumventing Apple’s payment system; and any unlawful use.

12. Limitation of Liability

The app is provided “as is.” To the extent permitted by law, the developer is not liable for the consequences of decisions made solely on the basis of data in the app, for data delays, undelivered messages, SOS signals, and notifications, for network or device failures, or for content posted by other users.

This does not limit any consumer rights that cannot be waived under applicable law.

13. Intellectual Property

14. Changes and Governing Law

The developer may change these terms and will notify you of material changes in the app. These terms are governed by the laws of Ukraine, without limiting mandatory consumer rights.
